Booking and purchase terms
These terms apply to bookings made and paid for in this system. They set out how a booking is made, what the price includes and how payment works.
Who you are contracting with
The booking and payment contract is concluded with the company named here. The accommodation itself is provided by the hotel you chose.
How a booking is made
Rooms and prices are shown on the hotel's own website. When you choose to book you are handed over to this payment system — here you see the final price, enter your details and pay. The booking is only ever concluded here.
- A price is held only briefly. A quote is valid for 15 minutes; once it expires the stay is re-priced before payment.
- If the price changes on re-pricing, both the old and the new total are shown above the pay button. A price is never changed silently.
- When you proceed to pay, the room is reserved and held for 30 minutes while the payment completes.
- A booking is confirmed only when the payment provider confirms the payment. Until then it is pending.
- We send the confirmation and your booking reference to the email address you gave.
You do not need an account. If you sign in before paying, the stay is attached to your account; if not, it is made as a guest booking and can be claimed later.
We do not sell a stay we cannot price: if any night has no published rate the booking is refused and you are told so. A price is never guessed and never shown as zero.
What the price includes
Every amount shown in this system is a final, tax-inclusive price — there is nothing to add. Prices are in euro.
The city tax is the one thing you pay on top. The hotel collects it at the desk; this system never charges it and no total here contains it.
Every rate plan states whether meals are included. Room-only means no meals are included; bed-and-breakfast means breakfast is included in the nightly price and there is nothing extra to pay for it.
Breakfast is included in the rate at: Bohema Hotel, Navalis and Prie Parko.
Payment
Payments are taken by Paysera. When you proceed to pay you are sent to Paysera's own pages, where you choose how to pay and enter your payment details.
This system never receives or stores your card number, expiry date or security code — you enter those on Paysera's own site. From the payment response we keep the amount, the currency, the payment status and Paysera's own payment reference.
Funds are collected into the hotel's own Paysera project. A payment confirmation is accepted only when it is signed and bound to that project; an unverified callback never confirms a booking.
Cancellation and changes
Cancellation terms depend on the rate you chose and on the hotel. Every hotel's and every rate's terms are set out on their own page: /cancellation
The terms you see before paying are the same ones shown on that page and on the hotel's website — all three read the same record.
There is no self-service way to change or cancel a booking in this system yet — contact the hotel directly.
Loyalty points
Points are earned only when you are signed in and only on paid bookings. They are shared across all of the group's hotels.
If a stay is cancelled or refunded, the points earned on it are reversed.
Right of withdrawal
The right to withdraw from a distance contract does not apply to accommodation. Article 16(l) of Directive 2011/83/EU withholds it where accommodation is supplied other than for residential purposes and the contract provides for a specific date or period of performance. Every booking made in this system names a specific arrival and departure date, so the exclusion applies to all of them.
You therefore have no 14-day cooling-off period, and a paid booking cannot be cancelled simply because you have changed your mind.
What can be cancelled, and on what terms, is set by the cancellation policy of the rate you chose. It is shown next to the price before you pay, repeated in your booking confirmation, and published in full at /cancellation. The version that applies is the one in force when you made the booking.
There are two kinds of rate. A non-refundable rate is never refundable. A flexible rate can be cancelled free of charge up to a stated deadline, after which it becomes non-refundable. That deadline is shown with the price and at /cancellation; it is counted in calendar days before the arrival date.
This exclusion does not affect your rights if the service is not supplied, or is not supplied as described.
House rules
ARRIVAL AND DEPARTURE
Bohema: reception is open 08:00–20:00. Check-in 16:00–20:00, check-out by 12:00. Minimum age for check-in is 18.
Navalis: reception is open 08:00–20:00. Check-in 16:00–20:00, check-out by 12:00. Minimum age for check-in is 18.
Prie Parko: reception is open 24 hours. Check-in from 16:00, check-out 06:00–12:00. Photo identification and a payment card are required at check-in. There is no minimum age for check-in.
Arrival outside reception hours must be arranged with the hotel in advance.
CHILDREN AND EXTRA BEDS
Bohema: children of any age are welcome. From age 8 the adult rate applies. Cot for 0–2 years free, on request. No extra beds are available.
Navalis: children of any age are welcome. From age 18 the adult rate applies. Cot for 0–2 years free. Extra bed for 3–16 years, EUR 18 per child per night.
Prie Parko: children of any age are welcome. From age 8 the adult rate applies. Cot for 0–5 years, EUR 10 per child per night. Extra bed from age 5, EUR 20 per person per night.
Cots and extra beds are not included in the booking total and are paid at the hotel. Their number depends on the room chosen and is subject to availability.
SMOKING
Smoking is prohibited in all rooms and indoor areas. Where this is breached a special cleaning charge of EUR 500 applies.
DAMAGE
The guest is responsible for damage caused to the room, its contents and hotel property. The cost of repair or replacement is charged at the hotel.
NO-SHOW
If the guest does not arrive and does not notify the hotel, the cancellation terms apply and the full amount of the booking is charged.
PETS
Pets are accepted by prior arrangement. A charge may apply.
Complaints and disputes
If something has gone wrong, speak first to the hotel you stayed at, or were due to stay at. Reception telephone numbers and email addresses are published at /contacts. Most things are settled fastest by the hotel itself.
If you are not satisfied with the answer, or the matter concerns payment, a refund or the booking system itself, write to group customer service: info@smilciu.lt, +370 46 404200.
Please make the complaint in writing and include: your name, an email address or telephone number we can reply to, the booking reference, the hotel and the dates of the stay, what happened, and what you are asking for. Attach any evidence you have — photographs, correspondence, proof of payment.
We register every complaint and reply in writing, through the channel it reached us, no later than 14 calendar days after we receive it. If we need longer to answer properly, we will tell you within that same period and say why.
If the dispute cannot be settled between us, a consumer has the right to apply for out-of-court resolution to the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba), https://www.vvtat.lt. The complaint must have been put to us in writing first. Your right to go to court remains in every case.
For anything concerning your personal data, write to the same addresses. You also have the right to complain to the State Data Protection Inspectorate (Valstybinė duomenų apsaugos inspekcija), https://vdai.lrv.lt.
Out-of-court dispute resolution
Governing law
Bookings made in this system are governed by the law of the Republic of Lithuania. The seller, UAB "Tubinas International", is established in Klaipėda, all three hotels operate in Lithuania, and the service is supplied in Lithuania.
We try to settle disputes between us first; how to complain is set out in the "Complaints and disputes" section. Where that fails, the dispute is heard by the courts of the Republic of Lithuania.
If you book as a consumer, this choice of law does not deprive you of the protection given to you by the mandatory consumer rules of the country where you habitually reside. A consumer may also bring proceedings in the courts of that country, and where a consumer is domiciled in the European Union we may bring proceedings against them only there.
If a booking is made for business purposes, in the name of a legal person, disputes are heard by the court of the Republic of Lithuania having jurisdiction over the seller's registered office in Klaipėda.
Changes to these terms
Your booking is governed by the terms in force when you made it. Later changes do not affect it.
